Quando o contrato prev\u00ea que a entrega das chaves depende da quita\u00e7\u00e3o de todas as parcelas ou taxas, a construtora est\u00e1 no seu direito ao reter as chaves at\u00e9 que o comprador cumpra com essas obriga\u00e7\u00f5es.<br><\/p>\n\n\n\n<p>Essa pr\u00e1tica \u00e9 uma forma leg\u00edtima de proteger o equil\u00edbrio do neg\u00f3cio. Afinal, n\u00e3o faz sentido entregar o im\u00f3vel se o comprador ainda n\u00e3o concluiu a parte dele no acordo. Nessas situa\u00e7\u00f5es, reter as chaves n\u00e3o \u00e9 abuso, nem gera automaticamente o direito a indeniza\u00e7\u00f5es.<br><\/p>\n\n\n\n<p>Por outro lado, existem casos espec\u00edficos em que a Justi\u00e7a pode entender que a reten\u00e7\u00e3o das chaves \u00e9 exagerada \u2014 especialmente quando o comprador j\u00e1 pagou quase tudo e falta apenas um pequeno valor. Nesses casos, o juiz pode autorizar a entrega das chaves e permitir que o restante seja cobrado depois. Mas \u00e9 importante refor\u00e7ar: isso n\u00e3o vale para qualquer situa\u00e7\u00e3o. Cada caso precisa ser analisado com cuidado.<br><\/p>\n\n\n\n<p>O que isso mostra? Que um contrato bem elaborado e o suporte jur\u00eddico adequado s\u00e3o fundamentais.
